Job Applicant Privacy Notice

This Privacy Notice (“Notice”) explains how the Palms Casino Resort entities owned and operated by the San Manuel Gaming and Hospitality Authority, an unincorporated instrumentality of the San Manuel Band of Mission Indians process the Personal Information of job applicants who are California residents.  This Notice applies to Personal Information we collect on all of our careers websites that include a link to this Notice, including palmscareers.com, and nextlevelcasinocareers.com, and to the Personal Information we collect when you provide us with your application in person (together, the “Careers Sites”).

This Notice describes the types of Personal Information we collect on our Careers Sites, how we may use that information, with whom we may share it, and the choices we provide you in regarding your use of your Personal Information. The term “Personal Information” in this Notice refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. This includes information that you provide to us, information that is collected about you automatically, and information we obtain about you from third parties. It does not include aggregated or anonymized information that is maintained in a form that is not capable of being associated with you.

This Notice may be updated periodically to reflect changes in our Personal Information practices. We will post a prominent notice on the site and/or send you an email to notify you of any significant changes to our Notice and indicate at the top of the notice when it was updated.

1. Personal Information We Collect


We may collect the following categories of Personal Information:
  • Identifiers, such as your name, address, email address, phone number, IP address, social security number, tribal identification number, and Careers Sites account information.
  • Protected classifications, including gender, age, ethnic background, veteran status, and disability status.
  • Internet activity information, including IP address and the job postings you view.
  • Professional or employment-related information, including such information as your work history, skills, professional certifications, languages spoken, and other information you provide on your resume/CV.
  • Education information, including such information as the college(s) you attended, the degrees you have obtained, and your field of study.
  • Inferences, specifically other jobs you may be interested in based on applications you have submitted or job postings you have viewed.

2. COOKIES AND OTHER TRACKING TECHNOLOGY


We, and third parties on our behalf, use cookies and similar tracking technologies (collectively, “Tracking Technologies”) to collect Personal Information automatically as you interact with our careers websites, to help us customize your experience and better manage content on our careers websites, including to:

  • Analyze our web traffic using an analytics package
  • Identify whether you already visited our careers websites
  • Store information about your preferences (e.g., cookie consent)
  • To recognize when you return to our careers websites
Cookies. When you visit our Career Sites, we (or third-party data or ad networks we work with) may send one or more “cookies” to your computer or other devices. Cookies are alphanumeric identifiers stored on your computer through your web browser and are used by most websites to help personalize your web experience. Some cookies may facilitate additional site features for enhanced performance and functionality such as remembering preferences, analyzing usage for site optimization, allowing third parties to provide social sharing tools, and serving images or videos from third-party websites. Some features on our Career Sites will not function if you do not allow cookies.

Managing Cookies.  If you do not want us to deploy any  cookies that are not strictly necessary in your browser, you may modify your choices by visiting our Cookie Settings page.  You may also exercise your preference by modifying your web browser setting to either (1) refuse some or all cookies or (2) notify you and ask for your permission when a website tries to set a cookie. If you want to learn the correct way to modify your browser settings, please use the “Help,” “Tools” or “Edit” menu in your browser or review the instructions provided by the following browsers: Internet Explorer, Google Chrome, Mozilla Firefox, Safari Desktop, Safari Mobile; and Android browser. We may use third-party service providers to monitor and analyze the use of our career website, such as Google Analytics.  Google Analytics is a web analytics service offered by Google LLC (“Google”) that tracks and reports website traffic. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics, available at: https://tools.google.com/dlpage/gaoptout.

Interest-Based Advertising. Many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (DAA) or the Network Advertising Initiative (NAI), both of which maintain websites where people can opt out of interest-based advertising from their members. 3. How We Collect Personal Information



We may collect your Personal Information in the following ways:


Personal Information You Provide to Us
During the application, recruitment, and onboarding process, we may collect, store and process the above categories of Personal Information directly from you when you submit them directly to us as part of a job application, when you share information about job postings with others, or when you sign up for a networking event.

Personal Information We Collect from Other Sources
From Recruiters and Headhunters: We may obtain Personal Information about you (such as your name, address, phone number, resume/CV, other files or content, and education and employment details) from recruiters and headhunters who submit it to us on your behalf in connection with job postings.
From Public Information: We may also collect your Personal Information from your public social media profile (on LinkedIn or other similar services) or from your referees to complement the Personal Information you have provided. We use this information for the purpose of evaluating and verifying your experience and qualifications in relation to specific job requirements. We do so to take pre- contractual steps at your request. If we request references, it is your responsibility to obtain consent from referees before providing their Personal Information.
From Background Screening Process:In some jurisdiction where legally permitted, we may collect Personal Information about you from third parties, such as employment agencies, former employers, and personal and professional references, or public sources to conduct lawful background screenings, to the extent permitted by law. We will provide you with acknowledgement and authorization forms accordingly.
Personal Information We Collect Automatically
As described in Section 2, like many companies, we may use “cookies” on the Careers Site to obtain certain information by automated means, such as the IP address of the device you use to connect to the Internet and the pages accessed. By collecting this information, we learn how to best tailor our Careers Sites to our visitors.

4. Why We Collect Information


We collect, process, store, maintain, and transfer your Personal Information as we determine reasonably necessary in order to perform our recruitment process. Your Personal Information is used in the recruitment process for purposes such as:
  • Determining your qualifications, skills, and background for a particular position;
  • Determining your right to work;
  • Conducting background checks and similar inquiries in compliance with applicable laws, and to otherwise comply with all applicable laws;
  • Communicating with you during the recruitment process;
  • Carrying out functions in relation to your future employment;
  • Managing and improving our recruitment process;
  • Understanding, promoting, and assisting in ensuring that our recruitment process is diverse and inclusive; and
  • Communicating with you about other job opportunities and networking events (in such cases, we shall never use any sensitive Personal Information).
Processing your Personal Information may also be necessary in order to allow us to comply with a legal or regulatory obligation.

5. How We Share Your Personal Information

We will not sell, share, or otherwise disclose your Personal Information for purposes unrelated to those detailed in this Notice without the prior consent of the applicant. To that end, we will take reasonable precautions to allow access to your Personal Information to only our employees, agents, contractors, or similar entities to the extent necessary for the purposes set out in this privacy policy. 
We may share your Personal Information in the following ways:
Between Affiliated Entities
Your Personal Information may be disclosed among our various affiliated entities for the purposes set out in this Notice.
To Third-Party Service Providers
In the course of our recruitment activities, we may make certain Personal Information available to third parties who provides services to us to support those activities. We will only do so where such a transfer is necessary, and in accordance with applicable data protection rules. In such instances, your Personal Information may be made available to the following types of service providers:

  • Companies that provide or help to operate our applicant database;
  • Companies that help with relocation support services;
  • Companies that help with verification/background checking services;
  • Cloud services companies that provide hosting, data storage, and other services pursuant to standard terms and conditions that may be non-negotiable;
  • Companies that help us improve our Career Sites. These third parties may provide data points including how much time you spend on specific pages, which links you choose to click, and data that helps determine user preferences. This information enables us to build and maintain our services with user feedback. These third parties may use cookies and other technologies to collect data on your behavior and devices such as the device type, browser information, and preferred language;
  • Companies that help us provide targeted advertising to potential job applicants;
  • Companies that help manage candidates’ recruitment life cycle via cloud-based recruitment software solutions (known as applicant tracking systems).
Legal or Regulatory Requests and Investigations. We may disclose your Personal Information to third parties under the following circumstances (i) to comply with relevant laws or regulations, to respond to a court order, administrative or judicial process, such as a subpoena, warrant, court order, or government audit; (ii) in response to lawful requests by public authorities (such as national security or law enforcement); and (iii) as necessary to establish, exercise or defend against potential, threatened or actual litigation (such as adverse parties in litigation). We may also need to share your Personal Information with tax authorities, courts, regulators, the police, and other governmental authorities where we are required or permitted to do so by law in jurisdictions in which we operate.

Business Transactions. We may share your Personal Information with a potential buyer (and its agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all our assets (including in the event of a reorganization, dissolution or liquidation), in which case, Personal Information held by us about you will be among the assets transferred to the buyer or acquirer. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Information in the same way as set out in this Privacy Notice.


Protection of the Company or Others. We may share your Personal Information where necessary to protect our operations, including to investigate, prevent, or take actions regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies.

6. YOUR CHOICES

We provide you with certain choices with respect to your Personal Information that you provide to us. They are as follows:
  • Know/Access. You may obtain a copy, or a list of categories of the Personal Information that we hold about you, as well as other supplementary information, such as the purposes of processing, and the entities to whom we disclose your Personal Information.
  • Correction. You may request us to rectify, correct or update any of your Personal Information held by us that is inaccurate.
  • Deletion. You may request that we delete the Personal Information that we hold about you.  However, we may refuse such a request if there are compelling legitimate grounds for keeping your Personal information, for legitimate purposes, or as required by law. In addition, in the event your deletion request is honored, we may retain a record of your deletion.
  • Portability. You may request to receive the Personal Information we hold about you in a structured, commonly used, and machine-readable format so that you can provide that Personal Information to another entity.
  • Opt-Out Sale / Opt-Out of Sharing. You may request to opt-out of the sale and sharing of your Personal Information with third parties. We do not sell your Personal Information for money, but like many websites, we use cookies, pixels, and similar technology, and we share certain information, such as your IP address or device identifiers, to certain third-party advertisers in order to improve your user experience and to optimize our marketing activities.
We will not discriminate against you for exercising any of your choices described in this section.
Exercising Your Choices
Unless specified above, you may exercise these choices by submitting a request on our website, emailing us at: hr@palms.com with the subject “Job Applicant Choice Request”, or you may contact us at 1-866-752-2236 and request the HR Department.  When you submit a request, before honoring such a request, we may take additional steps as necessary to verify your identity.

You may also opt-out of sharing your personal information with third parties for cross-contextual behavioral advertising purposes by using an opt-out preference signal, which we will honor and process for you in a frictionless manner. To start using an opt-out preference signal, please refer to the instructions provided here. You will need to submit a separate opt-out of sharing request on each device and browser you use to visit our Career Sites.  Please note that you may still receive generalized ads after opting out of targeted advertising.

You may authorize someone to act as your agent and submit a request on your behalf. You must supply your agent with written permission to act on your behalf, and your agent must provide proof of such authorization before we will act upon the request. If you are submitting a request to access or delete through an authorized agent, you must verify your identity directly with us as described above, unless your authorized agent is acting pursuant to a power of attorney under applicable law.


7. RETENTION

We will retain your Personal Information for a period of up to four (4) years from the date we make an employment decision regarding your job application, unless otherwise required or authorized by applicable law. Our service providers will retain your Personal Information solely in accordance with our instructions and will not retain your Personal Information longer than the periods mentioned above. We take measures to destroy or permanently de-identify Personal Information if required by law or if the Personal Information is no longer required for the purpose for which we collected it.



8. SECURITY

We maintain and contractually require third parties we share your Personal Information with to maintain appropriate physical, technical and administrative safeguards to protect the security and confidentiality of the Personal Information you entrust to us. These safeguards are designed to protect your Personal Information from loss and unauthorized access, copying, use, modification or disclosure.  However, we cannot guarantee that loss, misuse, unauthorized acquisition, or alteration of your data will not occur. Furthermore, we cannot ensure or warrant the security or confidentiality of information you transmit to us or receive from us by Internet or wireless connection, including email, phone, or SMS, since we have no way of protecting that information once it leaves and until it reaches us.


9. MINORS PRIVACY

The Careers Site and its content are not directed at minors under the age of 18. If you are not yet legally an adult (under 18), please use this Careers Site only after obtaining permission from your parent or legal guardian.

We will not knowingly collect Personal Information about visitors under the age of 18 or knowingly allow such persons to register as users. In the event that we learn of having collected Personal Information from a minor under age 18 without verification of parental consent, that information will be deleted as soon as practical.

The Careers Sites may contain links to other third party websites for your convenience and information, or you may have been directed to the Careers Sites from a third party website(s). These websites may be operated by companies not affiliated with us. These sites may have their own privacy policies, which we strongly recommend you review if you visit any such websites. We are not responsible for the content of any sites that are not affiliated with us, any use of those sites, or the privacy practices of those sites.
